Garden waste collection service terms and conditions

1. The service

The garden waste collection is a voluntary opt in service (referred to as the service).

It is provided by Chorley Council or any contractor it may choose to engage (referred to as 'us', 'our', 'we' 'the council').

2. Term

The garden waste collection service starts annually from 1 May and expires 30 April the following year. Collections are fortnightly with a minimum of 22 collections per year per bin. There are no collections over the Christmas and New Year period or during adverse weather conditions which make collections difficult and unsafe. The council reserves the right to cancel collections without notice.

3. Payment

A garden waste collection fee is payable annually up front for each bin. The full annual fee is payable if you join at any time after 1 May. There are no discounts or part year adjustments. Fees may change. It is your responsibility to arrange payment yearly. There is a charge for lost or stolen bins. We may keep your payment details for future garden waste collections.

4. You agree to

Pay the annual fee for the collection of each bin and undertake to do this yearly if you wish to renew your subscription for the following year. Your subscription is non-transferable. Please place the sticker we send you on the bin as shown. Place only garden waste in the grey bin provided. Present the bin for collection by 7.00am on your collection day and bring the bin back in after collection. Only grass cuttings, hedge clippings, small tree loppings, twigs, bark, leaves, straw, hay, flowers, plants, small branches, fallen fruit, and rabbit bedding can be placed in the garden waste bin. Food waste must not be placed in the garden waste bin. The bin lid must be fully closed. No side waste will be collected. Contents should not be packed down making the bin difficult to empty. It is the resident's responsibility to make sure waste will empty freely from the bin for the next collection.

5. We agree to

Provide a 240 litre grey garden waste bin free of charge for every collection paid for. We will send you a sticker to display on your bin. We will collect your garden waste as explained under section 2. If we miss your bin collection it must be reported within 48 hours and we will collect within 24 hours.

6. Permit/ Stickers

We will issue a bin sticker upon receipt of payment of the annual subscription. This may take up to 12 working days to arrive. You will need to get in contact to replace a lost or damaged sticker.  

7. Refunds

Except for cancellations under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations 2013, we will not refund or part refund the fee. We will not refund for missed collections.

8. Cancellations

You have 14 days from the day you pay to change your mind. We will refund what you have paid only if and when you return the bin to us. To cancel you must write to: Chorley Council, Civic Offices, Union Street, Chorley, PR7 1AL or you can email contact@chorley.gov.uk.

9. Assisted collections

An assisted collection is available upon request for eligible households. If you already receive an assisted waste collection this will automatically be applied when you subscribe.

10. Other conditions

We can only provide a service to domestic properties that are accessible by our collection vehicles. We reserve the right to change collection days and weeks.
We will stop the service if it, or the bin is misused. No refund will be given.
We will not empty a bin unless it has a valid sticker. It must be a Chorley Council supplied bin. Garden waste from other receptacles will not be collected.
Contaminated bins will not be collected. You will need to remove any contamination before collection resumes. The Service is property based. If you move you cannot take the bin with you. The bin remains the Council's property. We will not be liable for any delay or failure to provide the Service if the delay or failure is outside our control. In the event of cold weather contents may stick in the bin meaning it may not empty correctly, please be aware this will not be treated as a missed bin, and we will not return until your next regular collection date.

11. Your rights

These terms and conditions do not affect your statutory rights.

12. Personal data

We will only use your details for this service to contact you by letter, phone, or email to do with garden waste or similar services provided by the council that may interest you. We will only share information with our contractor to collect your garden waste. You may tell us at any time if you do not want to receive marketing communications from us by writing to us with your full name and address. We may use information for analysis in order to improve services and will be anonymised prior to disclosure e.g. under the Freedom of Information Act 2000 regarding service take-up volumes.
