Disputes

  1. Should any dispute arise between the council and the hirer with reference to these terms and conditions and/or the booking form and/or as to any act or thing to be done in pursuance thereof arising out of anything in respect of this, whether during the continuance of the hire or upon the determination of the hire by effluxion of time or by any act of either party or otherwise, then the hirer must follow the complaints procedure.
  2. Should  the  dispute  fail  to  resolve  then  it  shall  be  referred  to  a  single  arbitrator  to  be appointed in the case of difference by the president for the time being of the Institute of Arbitrators at the instance of the party first applying to him and this shall be deemed to be an arbitration agreement  within  the  provisions  of  the  Arbitration  Act  1996  which  shall  continue  in  force notwithstanding the termination or cancellation or repudiation by either party.
